CHARITIES

Our cross-disciplinary charity team draws on expertise across the firm, providing charity clients with a comprehensive service, allowing them to make the best of their valuable resources.

We manage a number of local charities and are experienced at dealing with the day to day administration of these matters. We are also able to advise on the creation of charities, registering your charity with the Charity Commission and tax efficient charitable gifts.

We also work closely with specialist charity lawyers and are able to refer more substantial and complex issues to them, if necessary.

Our charity services include:

  • Constitutions and governance
  • Trustee obligations
  • Operational issues
  • Commercial agreements and funding agreements
  • Outsourcing, restructuring, mergers and amalgamations
  • Joint ventures
  • Employment
  • Dispute resolution
  • Commercial Property
  • Legacies and wills (including probate and legacy disputes)

Examples Of Our Experience: Amalgamation of Trusts and first registration of land

We acted for a large Diocese with many varied land holdings across the South East in relation to the dissolution of old trusts dating back to the 18th century and the amalgamation of other small trusts into one main diocesan trust. This involved dealings with the Charity Commission, preparation of constitutional charity documentation, transfer of all trust property to the main trust and first registration of the property portfolio at the Land Registry. The work required careful analysis of a large volume of very old trust documentation and title deeds, dealing with trusts where there were no living trustees, preparing documentation for appointment of new trustees and registering property at the Land Registry where often there were no title deeds at all.
